Regular Meeting
December 19, 2002
Roll Call: Councilors Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli Present.
Staff present: John Salomone, City Manager, Bea O’Hora, Comptroller, William Lupien, Superintendent of Engineering Services, Vijay Mital, Director of Planning and Economic Development, Nancy Hussey Assistant Corporation Counsel, Debra McCormick, City Clerk.
Pledge of Allegiance to the Flag – Juliana Riordan, a third grade student at Owasco Elementary School lead the pledge.
Presentations and Proclamations – Presentation by Downtown Auburn Business Improvement District
Sandra Craner, Executive Director of the ADP/BID group presented Mayor Carnicelli and Vijay Mital a plaque in appreciation for their support.

City Manager’s Report –
The City Manager reported the following:
· A quilt that the Cayuga Home for Children made and sent to NYC Fire Department Company #8 will be displayed in City Hall’s Lobby.
· The City has received a request to ring Old Wheeler on New Years Eve at midnight.
· Sue Chandler, City Assessor sent a memo to the City Manager regarding the low income senior tax exemption. She reported that the County has raised the income level and was asking if the city would also.
Public to be Heard –
Walt Aikman 17 Liberty St. - spoke to encourage council to support the resolution to accept the DEC grant that was on the agenda. He also updated council on what his “Grow Auburn Trees” group has been doing. He also spoke as Chair of the Cayuga County Environmental Management Council regarding feral cats. He shared facts on the harm feral cats can do to other animals, and suggested that feeding and watering them is not the answer. Then he spoke briefly about watershed management.
Mike Sweeney, Foster Rd Homer NY – spoke about pest control, specifically cats and crows. He also asked for a contact in the city to talk with about doing business. He owns a pest control service.
Alicia McKeen, member of Feral Cat Friends – spoke to council in support of the trap neuter and release program and disputed statements made by Mr. Aikman about the harm feral cats do.

Resolution
Council Resolution #230 of 2002 determination of significance City of Auburn NYS Empire Zone Boundary Amendment 2002 pursuant to the New York State Environmental Quality Review Act. Vote: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Council Resolution #231 of 2002 authorizing the Mayor to enter into an agreement with New York State Department of Environmental Conservation. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Sewer - Water Repair Program Resolution #232 of 2002 authorizing the replacement of a sewer line under the Sewer-Water Repair/Replacement Program. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Council Resolution #233 of 2002 authorizing appointment to the Mayor’s Social Justice Task Force. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Award Resolution #234 of 2002 authorizing award for demolition of 57 and 61 Owasco Street and 10 –12 Bellevue Place to Mark Cerrone of Niagara Falls, New York, in the amount of $53,205. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Council Resolution #235 of 2002 authorizing the Mayor to execute an agreement with the State of New York for landfill services for the Auburn Correctional Facility. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Council Resolution #236 of 2002 authorizing the City Manager to effect the transfer of $10,000 from the Contingency Fund to the Animal Control-Services Fund to assist with the control of public nuisance animals. Motion by Councilor Jacobs to amend resolution by adding a line, “ affective upon formation of animal advisory committee”. Seconded by Councilor McNabb. Vote started and stopped for discussion. Motion to rescind the amendment by Councilor Jacobs and seconded by Councilor Dempsey. Motion to amend resolution to add the word “fowl” so that the resolution applies to animal and fowl control. By Councilor Jacobs and seconded by Councilor Dempsey. Vote to amend resolution. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Vote on resolution as amended. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Local Law
Re-designation of Local Law #3 of 2002 petitioning the State of New York and its Department of Economic Development to amend the City of Auburn Empire Zone to Local Law #4 of 2002. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Mayor Carnicelli asked if the first reading of Local Law #5 could be waived. Council agreed. Local Law #5 of 2002 Amending Local Law#3 of 2002 entitled “Electing a Retirement Incentive Program as authorized by Chapter 69, Laws of 2002 for the Eligible Employees of the City of Auburn”. Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli vote aye. PASSED.
Tabled Legislation - None
Other Business –
Councilor Jacobs asked about payments being made to election inspectors by the city. The City Manager and City Clerk responded.
